Whistle-blower sues Toyota Motor Vietnam

Le Van Tach, who exposed technical faults in Toyota Motor Vietnam’s car manufacturing, has begun court proceedings to sue the company for unfair treatment and violating his privacy.
Tach has sent his petition against Toyota Motor Vietnam (TMV)’s General Director Akito Tachibana to the People’s Court in Vinh Phuc Province’s Phuc Yen Township.
He said Tachibana discriminated against him when he suspended Tach from work and then transferred him to an inferior job after he went public about TMV’s technical faults. Tach has asked for TMV’s apology, public admittance of frabricating false evidence and compensation.
In addition, Tach proposed that Phuc Yen and Vinh Phuc police’s investigative agencies, the Ministry of Public Security and People’s Procuracies at different levels bring the company to the court for their actions and violations of his e-mail privacy.
“Tachibana and his subordinates abused their power to violate my private e-mail and intentionally fabricated and disseminated their fabrication in order to besmirch my name,” Tach said in his petition.
Tach said that after disciplining him, TMV fabricated evidence and issued a notice to all employees claiming that Tach been motivated to close the company.
In his petition, Tach proposed to bring Tachibana and his subordinates to trial for violating personal correspondence under the Criminal Code’s Article 125 and for slander in accordance with the law’s Article 122.
On June 13, after Tach exposed Toyota’s technical faults to the mass media, which led to a company recall of nearly 9,000 Innova model cars, the company decided to suspend Tach for three months during which time he only received 50 percent of his monthly salary.
The company said the suspension was not connected with the whistle blowing but was related to Tach’s behaviour which had negatively affected the work and reputation of other employees.
After the reconciliation meeting failed to reach a mutual agreement, Tach said he would sue the company for its punitive action and violation of his private e-mails.
At the August 24 disciplinary council meeting, general director Akito Tachibana said after checking the company’s internal email system, MTV discovered Tach’s use of his company email address to send dozens of love letters to a woman.
Tach claimed that the MTV management had abused their power when accessing his own email account without his prior consent and the act violated his right to privacy.
